New NY Law to Allow Remote Notarization

The legislation will help to streamline the notarization process as the industry adapts to business online

Any New York notary public soon will be able to perform remote notarizations for paper and electronic documents.

The bill, entitled the Remote Online Notarization law (S1780C/A399B), is sponsored by State Sen. James Skoufis and Assemblymember Nily Rozic and was signed by Gov. Hochul, announced the New York State Land Title Association.

The bill will become law once the legislature passes and the governor signs chapter amendments which, according to a NYSLTA spokesperson, 'will likely happen in the early part of 2022."

NYSLTA also acknowledged Assemblymember Kenneth Zebrowski, chairman of the Committee on Governmental Operations, for helping to advance the measure.

“This legislation will help to streamline the notarization process as our industry continues to adapt," said Bob Treuber, NYSLTA executive vice-president. 

Notably, the new law will simplify real estate transactions across the state as homebuyers and sellers can now conduct their businesses remotely remotely, said Chris Hultzman, vice president of the First American Title Insurance Company. 

New York is not the first to pass this type of law. Many other states had approved online notarization long before the pandemic. New York State passed an executive order during the pandemic allowing notaries to sign documents using audio-video technology. After it demonstrated to be of great value, the bill for full remote notarization was pushed forward.
